Wisdom: Any competent lawyer can win a strong case with enough hard work--and lots of billable hours. It takes wisdom to size up the facts and law and formulate a strategy to win quickly and efficiently. Scott T. Cliff is known for his uncanny ability to find and exploit the opposition's weaknesses to gain the upper hand, whether in mediation, arbitration or trial. But wisdom also requires speaking frankly to clients with weak claims or defenses. No one wins when lawyers rack up a bill fighting a battle that can't be won. We believe in straight talk as soon as it is called for.
Efficiency: We don't think you should have to pay your lawyer by the hour to sift through boxes of documents to get his or her "head back in the case" whenever a new deadline requires action on your behalf. Using state-of-the-art evidence management software, we work with clients to build an electronic MAP of each case, typically before the client's first meeting with the lawyer. Each client's intimate knowledge of the facts is captured, preserved and built upon from day one. The results are not only reduced cost, but also a more rapid, fluid and comprehensive command of each case. Frankly, it scares us to think back on the "old way" of doing things.
Preparation: Being ready and willing to go to trial is essential in every case. The vast majority of civil cases filed in state and federal courts settle before trial. That is a well-known fact. But you'd be shocked at how many lawyers plan on not having to go to trial. Deep down inside, such lawyers harbor an eagerness to settle that turns to desperation as trial draws near. Experienced opposing counsel can "smell" such fear and will exploit it. Scott T. Cliff likes to try cases. His readiness to do so is as evident in mediation as it is in the courtroom.
